Terms of Service

Effective 2026-07-31 · Last updated 2026-07-31

These Terms of Service ("Terms") govern your use of Waxcrest ("we", "us", "our", the "Service"). By visiting waxcrest.app, joining the waitlist, opening a Drop-Window alert, or buying anything from the store, you agree to these Terms. If you do not agree, please do not use the Service.

What Waxcrest is

Waxcrest is a read-only sealed-Pokémon-monetary-product tracker with three surfaces:

  1. A price-aggregation feed that pulls sold-listing data from a handful of secondary-market venues and publishes cross-source medians.
  2. A Drop-Window alert that emails you when a SKU you've opted into crosses a per-source price threshold.
  3. A store that sells sealed Pokémon product — currently booster boxes, collections, and elite trainer boxes in English and Japanese.

Waxcrest is a hobbyist analytics and shop tool. It is not investment advice, a brokerage, a price-prediction service, or a tax advisor.

What Waxcrest is not

  • Not investment advice. The aggregated medians and any commentary we publish — in the journal, on landing copy, or in the catalog — are informational. They are not a recommendation to buy, hold, or sell any specific sealed SKU. We are not a registered investment adviser, and we do not represent ourselves as one. If you make purchases or sales decisions based on what you read here, you do so at your own risk.
  • Not a guarantee. Cross-source medians are computed from third-party venue data and can diverge from in-store sell-through by name, set, condition, and timing. A median is the middle of the dataset we sampled — not the price any specific seller is offering or any specific buyer is paying right now.
  • Not singles, not graded, not raw. Waxcrest sells sealed product only, in English and Japanese printings where the manufacturer licenses them. We do not sell single cards (raw or graded), graded sealed product, code cards, factory-sealed mint product from opened sets, or any product represented as "first edition" without the manufacturer's own seal of authenticity.

Acceptable use

You agree to use the Service for personal, non-commercial reference and shopping. You will not:

  • Scrape the feed (the alert pipeline, the catalog, the journal) at a rate that exceeds what a single person browsing would produce, or republish it without our written permission.
  • Use the Service to compile, train, or feed any algorithm, model, or paid product.
  • Reverse-engineer, decompile, or attempt to extract the source code of the price-aggregation pipeline.
  • Submit forms with content that is unlawful, harassing, fraudulent, or that impersonates anyone else.
  • Resell access to the alert or the catalog to a third party.

We may rate-limit, throttle, or block any call pattern that looks automated, regardless of whether it is technically scraping. We may also terminate or suspend your access for violations.

Drop-Window alerts

The Drop-Window alert is a best-effort email about pricing movement on opt-in SKUs. Specifically:

  • Best-effort, not an SLA. Delivery failures, queue delays, or inboxes that drop the message into spam do not constitute a breach. If you make a buy/sell decision on a price you expected to see and the alert arrived late, we are not liable for that decision or its outcome.
  • The "~90 seconds" figure on the home page is a marketing claim about our alert pipeline latency, not a contractual service level. Real latency depends on upstream venue polling cadence, email-provider queuing, your inbox filtering, and the path between them.
  • Push notifications and Discord webhook delivery (when configured as bonus channels) are convenience add-ons and are not the primary delivery surface. The email is.
  • Trigger thresholds are computed from the same cross-source median discussed above and inherit its limitations. A "drop" is a threshold crossing of one or more source listings against the median, not a guaranteed reduction in what any one buyer would pay.

To stop receiving alerts, use the one-click unsubscribe link in any alert email. Unsubscribing removes you from the alerts you no longer want; it does not remove your broader waitlist entry unless you also request that.

Account features (planned)

Waxcrest intends to ship a member-account feature for portfolio tracking, saved filters, and per-SKU alert configuration. When it does, additional account terms (password rules, allowed uses of the account, suspension procedure) will be added to this document. Until that ships, there is no member account to apply terms to.

The store — buying sealed product

Checkout

Checkout is a hosted redirect to Stripe Connect. Card details (and ACH, Apple Pay, Google Pay, or any other payment method Stripe surfaces at the time of purchase) are entered on Stripe's hosted page. Waxcrest never sees, stores, or transmits card or bank-account data. The data Stripe collects at checkout is governed by Stripe's Terms of Service and Stripe's Privacy Policy, not these Terms.

Pricing tiers

The catalog shows three Wartime Pricing club tiers: Initiate, Field, and Quartermaster. Each tier is sold as a separate product with a fixed price known at build time. The price you see at checkout is the price you pay, in USD. We do not add a surcharge for the payment method you choose.

Subscriptions and cancellation

Some tiers (and any future membership products) are billed as recurring Stripe Subscriptions at the stated monthly interval. You can cancel any time from the same Stripe customer portal link your receipt emails contain — there is no minimum term and no early-termination fee. Canceling stops the next billing cycle; the current cycle's entitlement runs to its end.

If we change a future tier's features or pricing, we will email subscribers at least thirty days before the change takes effect on their next renewal, so you can cancel first if you want.

Shipping and fulfillment

We ship sealed product in its factory seal from the moment it lands at our warehouse to the moment you open the courier's package. We do not open, reseal, weigh, or otherwise touch the inner contents. Sealed product is sold as-licensed and as-factory-sealed; we do not grade the seal tightness — that's the manufacturer's contract with you, not ours.

Shipping is currently domestic U.S. only, via a tracked ground service. We do not ship to P.O. boxes, freight forwarders, or forwarding addresses (forwarders void the tracked chain and we cannot guarantee the seal after that handoff). International shipping is on the roadmap; until it ships, the catalog will display "U.S. only" and an international order will be refunded before fulfillment.

Once a tracking number is generated and the carrier scans the package, risk of loss passes to you. We will help open a carrier claim if a package is lost in transit, but we cannot refund lost shipments — the carrier's insurance process governs that outcome.

A formal, expanded shipping policy will live at a separate /shipping route when we expand outside the U.S. Until that exists, everything in this Shipping section is the current policy.

Returns, refunds, and exchanges

Sealed product cannot be returned for a refund after the factory seal is broken. If your package arrives with a damaged factory seal, take a photo within forty-eight hours of delivery and email waxcrest@polsia.app; we will refund the order or send a replacement, depending on stock.

Other refunds (a wrong SKU, a duplicate order, an out-of-stock that slipped through) are handled case by case. Email waxcrest@polsia.app with the order number and the reason. We respond within five business days and resolve most cases inside fourteen.

Liability

To the maximum extent permitted by applicable law, our total aggregate liability for any claim arising from your use of the Service — whether the claim sounds in contract, tort (including negligence), statute, or otherwise — is capped at the greater of (a) the fees you paid us in the twelve months before the event giving rise to the claim, or (b) one hundred U.S. dollars.

We are not liable for:

  • Indirect, incidental, special, consequential, exemplary, or punitive damages.
  • Loss of profit, revenue, business, goodwill, anticipated savings, or data.
  • Decisions you make based on cross-source medians, alerts, or journal content.
  • Delivery failures, inbox filtering, or third-party platform outages (Stripe, hosting, email provider, GPUs we don't control).
  • Price changes on third-party venues we aggregate.

Some jurisdictions do not allow the limitations above; in those jurisdictions the limitations apply to the maximum extent permitted by local law. Nothing in this section is intended to exclude liability that cannot lawfully be excluded (fraud, death or personal injury caused by negligence, etc.).

Intellectual property

We own the catalog copy, the journal articles, the brand mark, and the price-aggregation pipeline. The underlying data we aggregate is owned by its source venues and is used under their terms.

You may quote short excerpts (one paragraph or fewer) from the journal for non-commercial commentary, with a clear attribution link back to the original post. You may not republish whole articles or publish derivative datasets of the price feed.

Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that violates these Terms or that we reasonably believe could harm the Service or other users. We will try to give notice when we can.

You can stop using the Service at any time. If you are a member when account features ship, deleting your account terminates the agreement for that surface specifically.

Governing law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or your use of the Service will be resolved in the state or federal courts located in Delaware, and you consent to personal jurisdiction there.

Changes to these Terms

If we change anything material, we will post the revised Terms at this URL with a new "Effective" date at the top, and we will email active waitlist members and account holders at least fourteen days before the change takes effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
